नीमच। 16 year old girl : 16 वर्षीय बालिका का अपहरण कर बलात्कार करने वाले आरोपी को 20 वर्ष का सश्रम कारावास। श्रीमान सुशांत हुद्दार, सत्र न्यायाधीश एवं विशेष न्यायाधीश महोदय, (पॉक्सों एक्ट), जिला नीमच द्वारा 16 वर्षीय नाबालिक पीडिता का अपहरण करके उसके साथ बलात्कार करने व जान से मारने की धमकी देने वाले आरोपी अमन पिता लोकेंद्र कुंगर जाटव, उम्र-22 वर्ष, निवासी-ग्राम गिरदौडा, थाना नीमचसिटी, जिला नीमच को धारा 363 भारतीय दण्ड संहिता, 1860 के अंतर्गत 03 वर्ष का सश्रम कारावास एवं 500रू अर्थदण्ड,

धारा 366 भारतीय दण्ड संहिता, 1860 के अंतर्गत 05 वर्ष का सश्रम कारावास एवं 1000रू अर्थदण्ड, धारा 376(3) भारतीय दण्ड संहिता, 1860 के अंतर्गत 20 वर्ष का सश्रम कारावास एवं 2000रू अर्थदण्ड, धारा 376(2)(एन) भारतीय दण्ड संहिता, 1860 के अंतर्गत 20 वर्ष का सश्रम कारावास एवं 2000रू अर्थदण्ड, धारा 506(2) भारतीय दण्ड संहिता, 1860 के अंतर्गत 02 वर्ष का सश्रम कारावास एवं 2000रू अर्थदण्ड एवं धारा 5(एल)/6 लैंगिक अपराधों से बालकों का संरक्षण अधिनियम, 2012 के अंतर्गत 20 वर्ष का सश्रम कारावास एवं 5000रू अर्थदण्ड से दण्डित किया गया।

प्रकरण में शासन की ओर से पैरवी करने वाले विशेष लोक अभियोजक जगदीश चौहान द्वारा घटना की जानकारी देते हुए बताया कि दिनांक 19.06.2021 को पीडिता की माता ने थाना नीमच सिटी पर उपस्थित होकर रिपोर्ट लिखाई की उसकी पुत्री पीडिता कल शाम को उसकी दादी को 6ः00 बजे उसकी मौसी के यहां पढाई करने का कहकर गई थी, किंतु वापिस नहीं आई। पीडिता माता व पिता ने उसे ढुंढा किंतू वह नहीं मिली, उसे शंका हैं कि उसकी पुत्री पीडिता को कोई व्यक्ति बहला-फुसलाकर ले गया हैं, इसलिए उसने पीडिता की गुमशुदगी की रिपोर्ट पुलिस थाना नीमच सिटी पर की जिस पर से अज्ञात व्यक्ति के विरूद्ध अपराध क्रमांक 303/2021 की प्रथम सूचना रिपोर्ट पंजीबद्ध की गई।

पुलिस नीमच सिटी ने विवेचना के दौरान दिनांक 19.06.2021 को अभियुक्त अमन के कब्जे से दस्तयाब किया गया। पीडिता ने पुलिस को बताया की आरोपी उसे बहला-फुसलाकर चित्तौडगढ (राजस्थान) ले गया था और वहां उसने उसके साथ बलात्कार किया हैं व किसी को बताने पर जाने से मारने की धमकी भी दी हैं। विवेचना के दौरान आरोपी को गिरफ्तार कर एवं पीडिता का मेडिकल कराकर उम्र के संबंध में आवश्यक साक्ष्य एकत्रिक करते हुए अनुसंधान पूर्ण कर अभियोग पत्र विशेष न्यायालय (पॉक्सों एक्ट), नीमच में प्रस्तुत किया गया।

अभियोजन द्वारा माननीय विशेष न्यायालय (पॉक्सों एक्ट) नीमच के समक्ष विचारण के दौरान पीड़िता सहित सभी महत्वपूर्ण साक्षीगण के बयान कराकर आरोपी के विरूद्ध अपराध को संदेह से परे प्रमाणित कराकर घटना की गंभीरता को देखते हुए आरोपी को कठोर दण्ड से दण्डित किये जाने का निवेदन किया गया, जिससे सहमत होकर माननीय विशेष न्यायालय (पॉक्सों एक्ट) नीमच द्वारा आरोपी को उपरोक्त दण्ड से दण्डित किया गया।

इसके अतिरिक्त माननीय विशेष न्यायालय द्वारा अर्थदण्ड की संपूर्ण राशि 12,500रू पीडिता को प्रतिकर के रूप में प्रदान किये जाने का आदेश भी दिया। न्यायालय में शासन की ओर से पैरवी विशेष लोक अभियोजक श्री जगदीश चौहान द्वारा की गई।

20 years of rigorous imprisonment to the accused who kidnapped and raped a 16 year old girl.

Mr. Sushant Huddar, Sessions Judge and Special Judge, (Pox Act), District Neemuch, Aman’s father Lokendra Kungar Jatav, aged 22 years, accused of kidnapping a 16 year old minor victim, raping her and threatening to kill her. Resident – Village Girdauda, Police Station Neemuch City, District Neemuch, 03 years of rigorous imprisonment and a fine of Rs 500 under Section 363 of the Indian Penal Code, 1860, 05 years of rigorous imprisonment and a fine of Rs 1000 under Section 366 of the Indian Penal Code, 1860, Section 376( 3) 20 years rigorous imprisonment

and a fine of Rs 2000 under the Indian Penal Code, 1860, Section 376(2)(n) 20 years rigorous imprisonment and a fine of Rs 2000 under the Indian Penal Code, 1860, Section 506(2) Indian Penal Code Under Section 5(L)/6 Protection of Children from Sexual Offenses Act, 2012, he was sentenced to 20 years rigorous imprisonment and a fine of Rs 5000 under IPC, 1860.

While giving information about the incident, Special Public Prosecutor Jagdish Chauhan, who appeared on behalf of the government in the case, said that on 19.06.2021, the mother of the victim appeared at the police station Neemuch City and lodged a report that her daughter the victim had given her grandmother 6:00 pm yesterday evening.

She had gone to her aunt’s house at 10 o’clock saying that she would study, but did not return. The victim’s mother and father searched for her but could not find her. She suspected that someone had lured her daughter away, hence she reported the victim’s missing person to the police station Neemuch City, from which a crime against unknown person was registered.

First information report number 303/2021 was registered. Neemuch City police, during investigation, seized the weapon from the possession of accused Aman on 19.06.2021. The victim told the police that the accused had seduced her and taken her to Chittorgarh (Rajasthan) and there he raped her and also threatened to kill her if she told anyone. During the investigation, after arresting the accused and getting the victim medically examined, collecting necessary evidence regarding the age, completing the research, the charge sheet was presented in the Special Court (Poxon Act), Neemuch.

During the trial before the Honorable Special Court (Pox Act), Neemuch, the prosecution obtained the statements of all the important witnesses including the victim and proved the crime against the accused beyond doubt and in view of the seriousness of the incident, requested to punish the accused with harsh punishment.

Agreeing to this, the accused was punished with the above punishment by the Honorable Special Court (Pox Act) Neemuch. Apart from this, the Honorable Special Court also ordered to provide the entire amount of fine of Rs 12,500 as compensation to the victim. The government’s advocacy in the court was done by Special Public Prosecutor Shri Jagdish Chauhan.
